Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Artifice Tactical website and services. By using our site or engaging our services, you agree to these Terms. If you do not agree, please do not use the site or our services.

Our Services

Artifice Tactical provides social media management and AI-powered content creation services for gun stores, ranges, and other firearms businesses. Depending on the engagement, this may include ongoing content production, scheduling and posting, community management, and growth strategy, or content production only, such as short-form videos, product and lifestyle photography, and brand identity assets. Specific deliverables, timelines, and pricing are agreed on a per-engagement basis, typically starting with a discovery call and confirmed in writing.

Discovery Calls, Proposals & Payment

Booking a discovery call does not create a binding agreement. Any pricing or scope we provide afterward is an estimate based on the information you supply and remains subject to written confirmation. Payment terms, deposits, and revision or cancellation policies are specified per engagement. Unless otherwise agreed in writing, payment is due as outlined in your proposal or invoice.

Client Responsibilities

• You are responsible for the accuracy of information, product details, and materials you provide.
• You represent that you have the legal right to use any brand assets, logos, or reference materials you submit to us.
• You are responsible for ensuring your use of delivered content complies with all applicable laws and platform policies, including firearms advertising rules and the terms of any platform where you publish.
• Any modification you make to delivered content after receipt, including but not limited to adding pricing, promotional text, or other elements, is done at your own discretion and responsibility.

Publishing & Account Access

We offer two ways to work together, and it's important you know which one applies to your engagement:

• Content production only. We deliver the finished content to you, and you (or your team) publish it on your own accounts, on your own schedule.
• Full social media management. We schedule and publish content directly to your accounts on your behalf. This requires you to grant us the necessary access (such as login credentials or platform-level permissions, e.g. Meta Business Manager) for the duration of the engagement.

Your social media accounts remain your property at all times. When we're granted access under a management engagement, we act solely as your authorized representative for the scope of that engagement, and you may revoke our access at any time. Revoking access before the end of an engagement does not entitle you to a refund for services already rendered.

Third-Party Platform Actions

While we design every deliverable with platform advertising policies in mind, content moderation on platforms like Meta relies heavily on automated systems, which can result in wrongful or inconsistent enforcement actions. Such decisions remain at the sole discretion of the platform and are beyond our control.

Whether content is published by you or by us on your behalf, Artifice Tactical has no control over, and assumes no responsibility for, the moderation decisions, policy changes, or enforcement actions of third-party platforms, including, without limitation, Meta (Facebook, Instagram), TikTok, YouTube, and Google. Any restriction, removal, demonetization, account suspension, or other sanction imposed by a third-party platform on your accounts or content, whether related to firearms advertising policies or otherwise, remains your sole responsibility. Artifice Tactical shall not be liable for any loss, damages, or costs resulting from such actions.

Force Majeure

Artifice Tactical shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to third-party AI tool outages, internet or software disruptions, or other events beyond our reasonable control.

Content Ownership & Usage Rights

Upon full payment for a project, you receive the rights to use the final delivered content for your business's marketing and promotional purposes, as described in your project agreement.

• Your assets remain yours. Any logos, product images, or brand materials you provide to us remain your property.
• Pre-existing and underlying materials. We retain ownership of our tools, workflows, templates, and any underlying methods used to produce your content.
• Portfolio use. Unless you request otherwise in writing, we may display delivered work in our portfolio and marketing materials as an example of our services.
• Prior to full payment, all deliverables, drafts, and previews remain our property and may not be used, reproduced, or published.

Acceptable Use

You agree not to use our site or services to engage in unlawful activity, to misrepresent our work, or to infringe the rights of others. We reserve the right to decline or discontinue any project that we determine, in our sole discretion, conflicts with applicable law or our standards.

Intellectual Property of the Site

All content on this website, including text, graphics, logos, and layout, is owned by or licensed to Artifice Tactical and is protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute site content without our permission.

Our Commitment & Disclaimers

We're committed to delivering professional, high-quality content and to standing behind the craft on every engagement. At the same time, marketing performance, audience engagement, and sales depend on many factors outside our control, including your products, pricing, offers, platforms, and market conditions. For that reason, we can't guarantee any specific marketing, engagement, or sales outcome from the content we deliver, and our services and website are provided on an "as is" basis except where these Terms expressly state otherwise.

Limitation of Liability

To the fullest extent permitted by law, Artifice Tactical shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of business, or loss of data, arising from your use of our site or services. Our total liability for any claim shall not exceed the amount you paid for the project giving rise to the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Aix-en-Provence, France.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the site or our services after changes take effect constitutes acceptance of the updated Terms.
